Das sagt Agel: | THE AGEL MARKETING (PAY) PLAN IN GERMANY? We have received inquiries from the field regarding the legality of the Agel Marketing Plan in Germany. Make sure everyone you talk to knows that the Agel Plan is 100% LEGAL in Germany. At no small cost to Agel, our German plan has been reviewed and approved by Agel?s top legal experts in Germany. The Marketing Plan for Germany is outlined in the European Policies and Procedures with the following differences: Terms and Conditions for Team Members Working and Doing Business in Germany. These Terms and Conditions for Germany apply in addition to the Policies & Procedures, the Compensation Plan and the Team Member Application to all Team Members registered or domiciled in Germany and are an integral part of the Agreement between Agel Enterprises (Netherlands) B.V. (?the Company?) and a Team Member. 1. Focus of the Company?s system. The main focus of the Company and its distribution system is the sale of products to end-users. Although the Team Members may recruit new Team Members to achieve an additional income, there is no obligation on the Team Member to do so. Accordingly, a Team Member may limit its activities to procuring sales of products without recruiting new Team Members. Any provisions suggesting otherwise shall be interpreted according to this provision. 2. Fast Start Commissions Replaced by First-Order Bonus. As the focus of the Company?s sales strategy is the sale of products, the Company will - in deviation from Section 2 of the Compensation Plan - not grant any Fast Start Commissions to a Team Member. Rather, the Team Member will be entitled to a bonus for the first order of a new end- user procured by the Team Member if the first order of the end-user equals or exceeds US$ 250 (?First-Order Bonus?). The First Order Bonus is calculated on the invoice amount and amounts to 14% if the invoice amount equals or exceeds US$ 250 and 20% if the invoice amount equals or exceeds US$ 1000. In addition to the First Order Bonus the Team Member will be entitled to the Commissionable Volume (CV ) of 500 for the Executive level package and 125 for the retail level package. 3. Independent Contract Status. A Team Member is an independent contractor. Accordingly, a Team Member is free in organizing his time, shall arrange on his own for the necessary means of operation and shall in general be able to freely organize his activities in compliance with the obligations stipulated in the Agreement. 4. Personal Success and Positions. The Compensation Plan sets out the positions which a Team Member may reach. However, it should be noted that as in any business high positions in the Company?s system require excellent sales efforts and talent and are not easily achieved. 5. Waiver of Enrollment Fee. There is no obligation on a Team Member to pay an enrollment fee and the Company hereby waives its right to request the payment of such fee. The purchase of the Start Kit is strictly optional. 6. Applicable Law and Jurisdiction. The parties agree that the Agreement with the Company is governed and construed by Dutch Law. The courts of the Netherlands shall settle any disputes arising in connection with the Agreement. 7. Severability. The terms of the Agreement shall be deemed severable. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provisions. 8. Conflicts of Provisions. If any provision of these Terms and Conditions conflicts with the terms of the Policies and Procedures, the Compensation Plan or the Team Member Application, these Terms and Conditions shall control. |
Unsinnige Gesetze | Wenn man ein Geschäft in Deutschland betreibt, dann muss man sich an die Gesetze halten, auch wenn einige Gesetze tatsächlich unsinnig sind! Meine persönliche Meinung ist, der Gesetzgeber soll sich da raushalten, jemand der volljährig ist, muss wissen worauf er sich einläßt. Man sieht aber auch, dass die tatsächlichen Feinde des Network Marketing, oftmals selbst Network Marketing Firmen sind, die sobald diese irgendeinen möglichen Verstoss feststellen, sofort mit Unterlassungsklagen etc... ankommen. Dies schadet der ganzen Branche!!! Aber, wenn man ein Geschäft aufbauen möchte, sollten die wichtigsten Produkte des Unternehmens zugelassen sein. |
